Alabama Senate approves "monstrosity" that would tie legislators' pay to median income

 The Alabama Senate this afternoon approved a junked-up "monstrosity" of a bill to tie legislators' pay to the median household income in Alabama.
Senators voted 28-6 for the proposed constitutional amendment after tacking on multiple add-ons including that a 2007 pay raise would be repealed immediately, lawmakers would forfeit pay in times of high unemployment, and legislators would have to reimburse the state if they accepted a controversial 2007 pay raise.
Senators in favor of the bill said they weren't even sure if all the changes were constitutional.
"What came out today was a monstrosity that we want to correct in conference committee," Senate President Pro Tempore Del Marsh, R-Anniston, said.
"The House is not going to concur with this. I'm going to beg them not to concur with this. We are going to send it to conference and fix it in conference," Marsh said.
The original proposal would change the way lawmakers are paid, giving them a base salary equal to the state's median household income. Additionally, they would be paid a daily expense allowance and mileage, identical to what state employees get, to cover travel expenses to Montgomery.
Lawmakers currently earn a minimum of $53,388 each year. The U.S. Census Bureau estimated the state's 2010 median household income at $40,474.
Under the new proposal, a lawmaker who lived 128 miles from Montgomery, for instance, would make about $45,980, according to an estimate from the Legislative Fiscal Office.
The proposed change is a constitutional amendment that would take effect immediately after the 2014 general election if voters approved it.
The bill comes after a much-criticized pay raise that lawmakers approved in 2007 without a recorded vote. The 61-percent pay raise included automatic cost-of-living adjustments.
But senators engaged in a type of political race of who could be more in favor of slashing legislative pay.
Sen. Roger Bedford, D-Russellville, accused Republicans of presenting a "Trojan Horse," noting the bill would not repeal the 2007 raise immediately and it would stay in place if voters voted down the proposed constitutional amendment
Bedford put on an amendment that lawmakers would forfeit their pay any time the state's unemployment rate crept above 5.2 percent, saying lawmakers should follow the governor's example.
Marsh said some of the opposition was a "show" and countered with an amendment of his own that lawmakers would have to give back any pay raise they took if they were in office when the 2007 raise was approved. Marsh said he didn't take the pay raise.
"I've withstood as much hypocrisy as I can for one day," Marsh said.

 Agnes Simpson, longtime owner of Alabama's WOOF radio stations in Dothan and the first woman to be named Alabama Broadcaster of the Year, has died. She was 87.

Simpson died Monday at her residence, officials with the Sunset Memorial Park Funeral Home and Crematory said Tuesday.
"In the radio business, she and I are old school," said longtime General Sales Manager Hal Edwards. "Not just because we were old but because we still cling to the ideal of serving our listeners. We always agreed that at WOOF Radio, our job was 'To serve the public interest and our business is the promotion of legal commercial enterprise' and we did that."
Simpson was born in Prescott, Ariz. and attended the University of Alabama, where she met her future husband, R.A. Dowling. She served in the U.S. Navy during World War II and moved to Dothan after the war.
She and her husband got a license to operate an AM radio station in 1947 and launched WOOF. After her husband died, Simpson obtained a license for one of Alabama's first FM stations, which launched in 1964.
Simpson sold commercials and also did news broadcasts on both stations. She won awards for her broadcasting, including the Silver Medal Award from the Dothan Advertising Federation and Alabama Broadcaster of the Year.
Simpson served as the president of WOOF until recently when she took ill.
Funeral services will be held at 11 a.m. on Saturday at the Episcopal Church of the Nativity.

WASHINGTON (AP) ? If Mitt Romney becomes president, he might need a crash course in Diplomacy 101.

He irritated Britons and Palestinians during a summer tour abroad and has declared Russia to be America's No. 1 geopolitical foe. Just last week, the Republican candidate, who plans a foreign policy speech Monday, raised eyebrows in Spain by holding it up as a prime example of government spending run amok.

That left Spaniards confused, and threatened to reinforce Romney's perceived handicap in international affairs, precisely at a time when lingering questions over the Sept. 11 attacks against the U.S. Consulate in Benghazi, Libya, has President Barack Obama on the defensive.

"I don't want to go down the path of Spain," Romney said Wednesday night during the first presidential debate. He argued that government spending under Obama has reached 42 percent of the U.S. economy, a figure comparable with America's NATO ally. "I want to go down the path of growth that puts Americans to work."

The remark was Romney's latest to cause international offense during a campaign that much of the world is closely monitoring.

The sensitivity reflects a wide understanding that Romney could prevail over President Barack Obama and take over as leader of the world's top military, economic and diplomatic power. If Romney becomes commander in chief, he could face a testy beginning with Europe's economic laggards such as Greece, Italy and Spain, whom he has beaten up regularly throughout the campaign.

No one contests that Spain's situation is dire, its economy in deep recession and unemployment hovering around 25 percent. But Spain's level of government spending is actually low by European standards, and significantly less than Germany and Scandinavian countries with far healthier economic prospects. Spain's woes were chiefly caused by the collapse of a property bubble that had fueled more than a decade of booming economic growth.

Spanish reaction to Romney was swift.

"What I see is ignorance of what is reality, but especially of the potential of the Spanish economy," said Deputy Prime Minister Soraya Saenz de Santamaria.

Maria Dolores Cospedal, leader of Spanish Prime Minister Mariano Rajoy's Popular Party, noted that "Spain is not on fire from all sides like some on the outside have suggested." Foreign Minister Jose Manuel Garcia Margallo called it "very unfortunate that other countries should be put up as examples" when the facts are skewed.

The criticism comes at an inopportune time for Romney. Obama has consistently outscored his challenger in polls asking about national security leadership, but the administration is struggling to deal with last month's attack on the consulate. Four Americans died, including the first ambassador killed in the line of duty in more than three decades.

Romney will have a chance to fully articulate his vision of America's role in world affairs when gives his address Monday at the Virginia Military Institute. But the furor in Spain, however minor, instead serves as a reminder of Romney's record of diplomatic stumbles, such as calling Russia ? not Iran or China, for example ? America's primary global adversary in March.

Russian President Vladimir Putin has since pointed to Romney's comment as justification for Russia's opposition to America's missile defense plans in Europe, saying the statement has "strengthened Russia's positions in talks on this important and sensitive subject."

Then on a July trip to Europe and Israel meant to burnish Romney's foreign policy credentials, the candidate criticized Britain over its preparations for the London Olympic Games. The comment baffled America's closest ally, drawing withering retorts from the British press, the Conservative prime minister and London's right-wing mayor. He also cited a private meeting with Britain's spy service MI6, in a significant breach of protocol.

In Israel, he followed up by declaring Jerusalem the capital of the Jewish state, which U.S. administrations have refused to accept for decades given Palestinian claims to the ancient city.

At a gathering of mostly American Jewish donors, Romney implied that Israel was more advanced than the Palestinians because of cultural superiority. The comment drew a charge of racism from the Palestinians' chief peace negotiator, with whom the U.S. has been working to reach a two-state peace deal with Israel and counter the threat posed by Hamas, the Palestinian militant group that rejects Israel's existence.

The comments in some ways reflect the demands of a presidential campaign and the thousands of speeches, fundraisers and public appearances each candidate must make.

Obama, too, has made mistakes. He was forced to apologize to Poland's president in June after using the expression "Polish death camp" in reference to an extermination center operated by Nazi Germany on Polish soil during World War II.

Romney's Spain quip might play well with Americans closely split on the election, who've heard from both candidates about the perils of economic contagion from Europe's debt crisis. It also was meant as a reminder of the $16 trillion U.S. debt that Obama presides over.

But even if it barely registered in a debate that most observers credited Romney with winning, the comparison may do damage. By singling out Spain, Romney ruffled feathers in a country he will probably need to call on for assistance if he becomes president. Spain has almost 1,500 troops in Afghanistan. It contributed fighter jets, refueling planes and naval vessels to the U.S.-led NATO mission that ousted Libya's Moammar Gadhafi from power.

"When you have a party or politician that has not been in power nationally for a while, there is a learning curve," said Frances G. Burwell, director of transatlantic relations at the Atlantic Council. "Europe has changed rapidly in terms of its governance rapidly. It's a very diverse place. But I'm sure a Romney administration would quickly get up to speed on this."

Burwell didn't see Romney's slighting of Spain or other European countries significantly straining ties or complicating tough questions on the horizon for any U.S. president, such as troop deployments in Afghanistan. But she said his critique of Spain's government spending level was somewhat strange considering the Madrid government is assertively cutting expenditures to avoid a European bailout and the high levels of American debt.

Added Heather Conley, European director at the Center for Strategic and International Studies: "Europeans ask the U.S., 'What about you?' This isn't helpful to either side of the transatlantic relationship."

LONDON (Reuters) - A cutting-edge laser scan of Stonehenge has shown how Britain's enigmatic neolithic monument was built to enhance the dramatic passage of sunlight through the circle of stones at midsummer and midwinter.

The slabs were intended to appear at their best in the dawn light on the longest day of the year and at sunset on the shortest, the scan for English Heritage found.

The two solstices attract thousands of visitors to Stonehenge, which dates back some 5,000 years.

The 3-D scan showed the stones to the northeast were carefully "pick-dressed" - worked to be smoother and neater than the other columns - creating a more dramatic spectacle from that angle.

Those stones were set where they would be seen first by people approaching the monument from the northeast along the Avenue, a processional route that would have been particularly spectacular at the midwinter sunset.

The scan uncovered 71 new images of axe-heads carved into the surface, doubling the number of known such carvings recorded in Britain. It also showed up damage and graffiti from Georgian and Victorian visitors.

In the 19th century, visitors could hire chisels at the site to hack off their own souvenirs from the stone.

According to the new evidence, the axe-head carvings were made in the Early Bronze Age, around 1,000 years after the first builders got to work at Stonehenge.

The lofty stones were transported some 400 km (miles) to the site in around 2,100 BC. Archeologists are still puzzled as to how the stones, weighing up to 45 tonnes, were made to stand upright.

Magnitude-5.8 earthquake hits Costa Rica

MEXICO CITY (AP) ? Seismologists say a magnitude-5.8 earthquake has shaken Costa Rica. There are no immediate reports of damage.

The U.S. Geological Survey says the quake occurred at 6:19 a.m. (8:19 EST; 12:19 GMT) and was centered eight miles (14 kilometers) north-northeast of the town of Nicoya. The epicenter was about 22 miles (35 kilometers) below the surface.

LORAIN, Ohio ? A Lorain Family known for decorating their home every Halloween was recently robbed?of some of their favorite spooky Halloween decorations.

When driving down Washington Avenue in Lorain you can always spot the Gillispie home every October. It?s the house with tombstones, goblins, skeletons and skulls all over their front yard however this past Sunday more than $400 of their favorite scary Halloween decorations were taken.

?Quite a few things were missing so, I?called my daughter and I said someone robbed us,? says Robert Gillispie of Lorain.

The family was so upset about the robbery they made a?sign that read ?To the Grinch that stole Halloween kiss my?.??and put it in their front yard for everyone to see. They later took it down so not to offend anyone. The family also?filed a police report.

Robert Gillispie says ever since he and his wife became ill nine years ago, they?ve learned to appreciate every holiday. That?s why they go all out and decorate their home every Christmas and Halloween.

?Since we got through the cancer and with the economy so bad, we don?t have the extra money to take super trips so this is our vacation. We just enjoy having family over, friends and giving them a thrill factor,? says Robert Gillispie.

?

This year?the?Gillispies have decorated?each room?with?a scary Halloween theme. They turned their kitchen into a gruesome?butcher shop, their living room is set up like a creepy Wizard of Oz complete with the Wicked Witch of the West and they turned their family room into a devil?s den.

Loryane Tyree lives right next door to the Gillispies. She says it?s a shame someone would steal their Halloween decorations.

?You can?t have anything anywhere you live and this is a nice neighborhood how people can do these things?I don?t know.?

The family has replaced some of the stolen decorations and they say the robbery will not ruin one of their favorite holidays.

QUESTION:

I would really like to get into real estate investing, but do not have the funding available to me.

I am not new to real estate and have worked with pre-foreclosures before. I used to find them, work out deals (sometimes short-sales) with the banks and then submit them to a network of buyers that I am affiliated with.

What I want to do now, however, is invest in real estate for myself rather than collecting small finders fees after doing all the work. I am an expert at finding nice properties for pennies on the dollar, but am unable to purchase these properties myself because of a lack of funds.

This would not be as big of a problem if it weren?t for my own poor credit score. Which makes it impossible for me to secure a loan using traditional techniques. So what would be required is either a true ?equity based? loan or ?no doc? loan; or a private investor.

Does anyone know how I can get money to make these investments, i.e. private loans, hard money, etc. and more specifically how to get in touch with them?

Alabama Senate approves "monstrosity" that would tie legislators' pay to median income

 The Alabama Senate this afternoon approved a junked-up "monstrosity" of a bill to tie legislators' pay to the median household income in Alabama.
Senators voted 28-6 for the proposed constitutional amendment after tacking on multiple add-ons including that a 2007 pay raise would be repealed immediately, lawmakers would forfeit pay in times of high unemployment, and legislators would have to reimburse the state if they accepted a controversial 2007 pay raise.
Senators in favor of the bill said they weren't even sure if all the changes were constitutional.
"What came out today was a monstrosity that we want to correct in conference committee," Senate President Pro Tempore Del Marsh, R-Anniston, said.
"The House is not going to concur with this. I'm going to beg them not to concur with this. We are going to send it to conference and fix it in conference," Marsh said.
The original proposal would change the way lawmakers are paid, giving them a base salary equal to the state's median household income. Additionally, they would be paid a daily expense allowance and mileage, identical to what state employees get, to cover travel expenses to Montgomery.
Lawmakers currently earn a minimum of $53,388 each year. The U.S. Census Bureau estimated the state's 2010 median household income at $40,474.
Under the new proposal, a lawmaker who lived 128 miles from Montgomery, for instance, would make about $45,980, according to an estimate from the Legislative Fiscal Office.
The proposed change is a constitutional amendment that would take effect immediately after the 2014 general election if voters approved it.
The bill comes after a much-criticized pay raise that lawmakers approved in 2007 without a recorded vote. The 61-percent pay raise included automatic cost-of-living adjustments.
But senators engaged in a type of political race of who could be more in favor of slashing legislative pay.
Sen. Roger Bedford, D-Russellville, accused Republicans of presenting a "Trojan Horse," noting the bill would not repeal the 2007 raise immediately and it would stay in place if voters voted down the proposed constitutional amendment
Bedford put on an amendment that lawmakers would forfeit their pay any time the state's unemployment rate crept above 5.2 percent, saying lawmakers should follow the governor's example.
Marsh said some of the opposition was a "show" and countered with an amendment of his own that lawmakers would have to give back any pay raise they took if they were in office when the 2007 raise was approved. Marsh said he didn't take the pay raise.
"I've withstood as much hypocrisy as I can for one day," Marsh said.

 Agnes Simpson, longtime owner of Alabama's WOOF radio stations in Dothan and the first woman to be named Alabama Broadcaster of the Year, has died. She was 87.

Simpson died Monday at her residence, officials with the Sunset Memorial Park Funeral Home and Crematory said Tuesday.
"In the radio business, she and I are old school," said longtime General Sales Manager Hal Edwards. "Not just because we were old but because we still cling to the ideal of serving our listeners. We always agreed that at WOOF Radio, our job was 'To serve the public interest and our business is the promotion of legal commercial enterprise' and we did that."
Simpson was born in Prescott, Ariz. and attended the University of Alabama, where she met her future husband, R.A. Dowling. She served in the U.S. Navy during World War II and moved to Dothan after the war.
She and her husband got a license to operate an AM radio station in 1947 and launched WOOF. After her husband died, Simpson obtained a license for one of Alabama's first FM stations, which launched in 1964.
Simpson sold commercials and also did news broadcasts on both stations. She won awards for her broadcasting, including the Silver Medal Award from the Dothan Advertising Federation and Alabama Broadcaster of the Year.
Simpson served as the president of WOOF until recently when she took ill.
Funeral services will be held at 11 a.m. on Saturday at the Episcopal Church of the Nativity.

For years, these were the only options I gave dates I was entertaining at my home. Sad, but true: I only knew how to make two things, and they required next-to-nothing in terms of preparation. I hated cooking and I didn't particularly love my dating life, either.

Instead of cooking for my significant others, I would always insist (er, "suggest") that we go out to eat, whether it was to the local gastropub I was obsessed with or to somewhere brand-new that neither of us had tried. You have little control over exactly how your meal is prepared, you rely on a server to take your orders and settle your concerns ? which can take a considerable amount of time on a busy Thursday night ? and you have to share the room with a dozen or more other people.?

So that year, with the encouragement of some of my chef friends, I began to learn how to cook. First, I went with easy (and I do mean easy) recipes: simple sandwiches, baked chicken, stir-fry. Recipes that didn't involve a whole lot of preparation, but still came out looking lovely. My then-boyfriend was thrilled; up until that point, he had always made our fun brunches and evening snacks ??or we'd just jet out of the house for our meals. We cooked together on a regular basis, which felt more intimate and involved more communication than simply deciding on a restaurant or ordering in.

Pat Barry silences boo birds at UFC on FX 5

During Friday's bout between John Dodson and Jussier Forniga, the boo birds started early. Though the two flyweights provided a strategic bout that ended in a knockout win for Dodson, some people in the Minneapolis crowd were not happy. They shared this displeasure by booing early and often.

One fan who was sitting near UFC heavyweight Pat Barry not only booed the fighters but then called them "pussies." When he said that word, Barry couldn't let it go. According to a video he posted, he asked the man to repeat what he had just said. When the man wouldn't, Barry chided him.

"Hey man, question! Gotta ask! What'd you say? Say it again. Say it loud so everyone can hear you," Barry said.

But the man waved it off. After Dodson knocked out Forniga, the man sat down with his hat pulled over his head. When Barry was confronted by him later, the man blamed his actions on having a bad week.

In the video, Barry called fans like this man roaches.

"That's why I call them roaches. There are more of them than us. They're never going to go away. They're feeble creatures."

Barry caught plenty of flak for using the word roach, but he isn't wrong in his point. Fans who spend hundreds of dollars of tickets to UFC events then spend the entire time booing and yelling vulgarities are hard to understand.

Do they have the right to yell what they want at fights? Absolutely. If they want to waste their money and lose their voices yelling instead of enjoying the fights, they can. But why do it? There are some fights that aren't exactly barnburners, but lately, fans have been booing even thrilling fights. Demetrious Johnson's win over Joe Benavidez also brought out the boos, for no good reason.

But after Barry stood up for his fellow fighters, boo birds are on notice. Watch where you boo, or you may be called out by a UFC heavyweight.

Monday has rolled around again; ?I am a bit more willing to lift my head off the pillow when I remember that it's Project Pinterest day, and I know that during a toddler nap I can check out the great projects blog friends have taken on.

If you aren't playing yet, jump on board! ?It's gentle pressure to go beyond the pinning and actually cook, bake, and make, and that, my friends, is golden.

I've got four, yes four, Pinterest recipes under my belt. One includes alcohol, hence I didn't get to taste it; the second is a simple, can-be-prepared-ahead dip; the third is meh, ok, but the fourth is a Crock Pot phenom that might just be the best sandwich to slap your taste buds with a handful of awesome.? Interested??
A few Sundays ago I hosted a Thirty-One party for a sweet friend, and in my food presentation "themed" it a football gathering. The Texans were coming on during the party after all! I also attempted to bribe my friends to come with promises of something alcoholic. At least 5 pregnant women showed up. Let's just say J enjoyed some fruity drink ending to his afternoon of football.?
This sangria, toted at "the best sangria ever" on Pinterest, apparently was a lot less sangria and more so a tasty fruity drink. I "forced" it upon every non-pregnant attendee for a taste test! They said it was good, but definitely not sangria.?

As it turns out I hadn't pinned all of them, but simply searched through Pinterest for them, so I re-searched, pinned, and here you have them. I wanted to keep it simply so I went with this tortilla roll-up recipe? and a corn dip I had a baby shower earlier this summer. ?The tortilla roll-ups were ok, and I think serving them with salsa would have upped their value a bit, but we enjoyed the corn dip and had plenty to bring over to our football loving neighbors who were in their garage man cave for the afternoon.?
But this my friends, is the real gem. AP, if you are pinning--pin this one! The picture isn't so pretty, but this recipe was by far the most amazing Crock Pot one we've found to date. I made this French Dip sandwich recipe and will make it again and again. J is requesting it weekly. Incredibly easy, incredibly tasty, this recipe is made for week nights, weekends, and even parties and holidays. Serve it on fresh pistolettes, and you've got the perfect game watching main dish. Promise me you'll try this one.?

The bill comes after a much-criticized pay raise that lawmakers approved in 2007 without a recorded vote. The 61-percent pay raise included automatic cost-of-living adjustments.
But senators engaged in a type of political race of who could be more in favor of slashing legislative pay.
Sen. Roger Bedford, D-Russellville, accused Republicans of presenting a "Trojan Horse," noting the bill would not repeal the 2007 raise immediately and it would stay in place if voters voted down the proposed constitutional amendment
Bedford put on an amendment that lawmakers would forfeit their pay any time the state's unemployment rate crept above 5.2 percent, saying lawmakers should follow the governor's example.
Marsh said some of the opposition was a "show" and countered with an amendment of his own that lawmakers would have to give back any pay raise they took if they were in office when the 2007 raise was approved. Marsh said he didn't take the pay raise.
"I've withstood as much hypocrisy as I can for one day," Marsh said.

 Agnes Simpson, longtime owner of Alabama's WOOF radio stations in Dothan and the first woman to be named Alabama Broadcaster of the Year, has died. She was 87.

Simpson died Monday at her residence, officials with the Sunset Memorial Park Funeral Home and Crematory said Tuesday.
"In the radio business, she and I are old school," said longtime General Sales Manager Hal Edwards. "Not just because we were old but because we still cling to the ideal of serving our listeners. We always agreed that at WOOF Radio, our job was 'To serve the public interest and our business is the promotion of legal commercial enterprise' and we did that."
Simpson was born in Prescott, Ariz. and attended the University of Alabama, where she met her future husband, R.A. Dowling. She served in the U.S. Navy during World War II and moved to Dothan after the war.
She and her husband got a license to operate an AM radio station in 1947 and launched WOOF. After her husband died, Simpson obtained a license for one of Alabama's first FM stations, which launched in 1964.
Simpson sold commercials and also did news broadcasts on both stations. She won awards for her broadcasting, including the Silver Medal Award from the Dothan Advertising Federation and Alabama Broadcaster of the Year.
Simpson served as the president of WOOF until recently when she took ill.
Funeral services will be held at 11 a.m. on Saturday at the Episcopal Church of the Nativity.

Former Bismarck Police Officer Guy McGlaughlin, who murdered his girlfriend Henrietta Redleg, will be released from prison about December of 2013. He will have served about 25 years of his 40 year sentence. Henrietta's brother says that McGlaughlin was angry because Henrietta had just ended her relationship with him. [Excerpts] The first witness set the tone and context for James Hilton Parker's murder trial. Did you ever hear Mr. Parker threaten one of the three children he was babysitting, Assistant State Attorney Steve Houchin asked? "Yes," replied William Ward, who worked with Parker at the Avon Park Police Department. "When she was asleep." Parker looked at Kaedyn and said, "I beat the s--- out of you," Ward testified. "And he looked up at me and smiled"... Parker, now 36, is charged with first-degree murder and aggravated child abuse. Houchin said Kaedyn, the daughter of Jennifer Short, had so many skull fractures they couldn't be counted when she died in May 2009... Short, a nurse who lived with Parker until they were arrested, was also charged with two felonies: neglect of a child with great bodily harm, and failure to report child abuse within the home... Asked to describe Kaedyn's nature, Short said the toddler was sweet and loving and liked to be held... She didn't want to leave her children with Parker after arguing on the night of March 29, 2009, when she went to work at 7 p.m. at Highlands Regional Medical Center. She unsuccessfully called at least three potential babysitters... Parker didn't want to go to hospital, and Short had to insist... Finally, Parker drove Short and Kaedyn to Highlands Regional, and Short screamed for help. "They got her into the ER and started working on her," Short's voice choked. Afterward, did Short ask Parker what happened? "He had two versions of that," Short said. Kaedyn fell over a pile of laundry and hit her head. She held her breath until she stopped breathing. And then a third version, that Kaedyn fell from the top of a bunk bed, and a fourth, that she stumbled on the carpet and hit her head on the laptop... "There was a lot of bleeding," Houchin said. "The brain was swelling. She had at least two strokes. The brain is in an enclosed container, and it was compressing the brain stem." Surgeons had to remove a portion of the skull plate and a portion of the baby's brain. Eventually, Kaedyn was moved to a hospice. She never regained consciousness, and Short decided after six weeks to disconnect life support. Parker could not explain why Kaedyn had so many skull fractures, blackened "raccoon eyes" and significant chest bruises, Houchin contended... [Full article here]

[Excerpts] A handful of witnesses took the stand Friday during the third day of former Avon Park police officer James Parker's murder trial including two medical doctors and a local detective... "Doctor, in regard to the fractures in the skull, was there more than one?"  [Assistant State Attorney Steve]Houchin asked. "It was a comminuted fracture. In other words there were multiple pieces of the fracture. It was a multiple fragment fracture," [Pediatric radiologist Ronald] Glass said. Glass stated that the fractures all appeared to have occurred around the same time due to the manner of the swelling. Glass also stated that the fractures were all acute fractures, meaning the injuries were from a one-time occurrence, not multiple or repeated stress of the bone. "In your opinion, are these the type of fracture that a small child will get if they simply fall on the floor?" Houchin asked. "No," Glass replied. "What about fall and hit their head on a laptop computer?" "No." "What about falling off a bunk bed? "No." "And why not?" asked Houchin. "Skull fractures are rare. According to Parker's deposition taken the morning after the incident, Kaedyn was a "clumsy kid"... [Excerpts] Defense attorney Howardene Garrett brought a couple of witnesses to the stand during James Parker's trial Tuesday morning that built up their theory about the cause of death of 20-month-old Kaedyn Short in 2009... Garrett introduced Dr. Edward Willey, a former medical examiner who currently works as a medical doctor and consultant. Willey testified that he did not agree with All Children's Hospital pathologist Dr. Hector Monforte's medical report, which was revealed to jurors on Friday... The doctor also disagreed with Dr. Ronald Glass's testimony Friday that Short's skull fractures were acute. Assistant State Attorney Steve Houchin cross examined Willey, asking for a number of clarifications to Willey's testimony... "You have not ever seen injuries such as this to a child's head from household falls?" Houchin asked. "I'm not sure I've seen anything as extensive as this from a household fall. But I have seen falls from upper bunks that are almost as severe," Willey said... Following Willey, the defense team brought Dr. William Lee to the stand. Lee is a professor of biomechanical engineering and medicine at University of South Florida. He works in a number of areas, and is an expert in injury biomechanics and accident reconstruction... [Excerpts] Jurors faced one inescapable conclusion in the trial of James Parker. The former Avon Park police officer, 36, was home with 22-month-old Kaedyn Short. Only his 5-year-old daughter and his girlfriend's 5-year-old daughter were present. And the toddler died of multiple head concussions... It took the jury six hours to determine Wednesday night that Parker was guilty of first-degree murder and aggravated child abuse. Parker was sentenced on the spot by retired Circuit Court Judge Dennis Maloney to life without parole on the murder charge, and 30 years to be served concurrently on the child abuse charge... The defense was unable to get around the X-rays of Kaedyn's skull, Houchin said Thursday. They showed multiple, separate fractures. One was so severe, it crushed the child's skull. "They were all on that night," Houchin said. She would not have survived any of the fractures shown in the X-rays if they had come days or weeks earlier. Parker's friend William Ward testified that Parker had once said "I beat the s--- out of you" to the little girl in Ward's presence. "He admitted he was there alone with her, and it wasn't an accident," Houchin said. "There were multiple blows." [Excerpts] Former Avon Park police officer James Parker III was found guilty of first degree murder and aggravated child abuse on Wednesday. Parker was sentenced to 30 years on each count, the sentences to run concurrently. After five hours of deliberation, the jury decided that Parker's actions on March 28, 2009 caused the multiple skull fractures that resulted in the death of 20-month-old Kaedyn Short. Kaedyn died on May 27 of that year after being taken off life support. Before the jury got the case on Wednesday, Parker, 36, spoke to jurors and the full courtroom about his account of what happened to Kaedyn, the daughter of his former live-in girlfriend Jennifer Short. Parker had stated numerous times during interrogations and interviews that Kaedyn was a "clumsy" child. The night of the incident, Short left Parker alone with Kaedyn and the two other girls in their home... The couple had had an argument... "Mr. Parker, you think Kaedyn tripped and fell, but you didn't see that... And you didn't see the second fall? You didn't hear any glass breaking or anything like that?" "No, sir." "So Kaedyn was walking back to her bed, after you changed her diaper, and she fell down?" "Yes," Parker replied. "I heard a fall, but it wasn't a typical thump on the carpet. It was a fall where she might have hit something"... Houchin accused Parker of giving "varying accounts" of the incident. Other witnesses, including Jennifer Short and Highlands County Sheriff's Office detective Tyrone Tyson, also stated that Parker's account had different variables to it... Parker testified that he did not call an ambulance, 911 or take Kaedyn to the emergency room even though she was going limp and slipping into unconsciousness as he cradled her in the chair after exiting the bathroom with the toddler. "Had I seen something different I would have called 911. If I thought her condition was an emergency, I would have," Parker said. Jennifer Short arrived a few minutes after Parker called her home. According to Short's testimony Kaedyn was "unconscious, limp and pale." "She turned the lights on in the house when she (Jennifer) came in so she saw something differently than what I saw," Parker explained. "So you're telling us that you hadn't even turned the lights on to look at Kaedyn to see what her condition was?" Houchin asked. Parker stated that he sat with the child in his arms and examined her in the light from the television. "I didn't feel it was an emergency. I didn't feel it was anything out of the ordinary," Parker said... During his closing statement, Houchin said, "Kaedyn Short could not be here. She can not take the stand and tell you what Parker did to her that night. But she has spoken to you. She should have been the safest little girl in the world. Her mama was a nurse and her mama's boyfriend was a police officer. Nothing should have happened to that little girl." Garrett closed her case with these words: "Nothing will ever be the same for anyone. Even if your verdict is not guilty, his life will never be the same. It is a tragedy for everyone. We know that he loves and is proud of Kaedyn. He said that to your faces. The prosecution has brought drama to this courtroom. It is to distract you from looking at the law. I ask you to look at the evidence and what it proves and does not prove." Nearly 10 doctors and expert witnesses testified during the trial to give details, some gruesome and hard to interpret, of what they believed to have caused the injuries that lead to Kaedyn's death. Judge Dennis Maloney reminded the three-man, nine-woman jury to do their duty when making the verdict. Jennifer Short, 28, was indicted in June of 2009 for not reporting child abuse, and failure to secure medical services/ failure to protect a child from child abuse. [Excerpts] The public defender's office is already preparing the paperwork for the appeal of James Parker III, convicted Wednesday in the murder of 22-month-old Kaedyn Short. Parker, 36, a former Avon Park police officer, was driven Friday morning to the Department of Corrections' Central Florida Reception Center in Orlando, said Major David Paeplow at Highlands County Jail. Parker's attorney, Howardene Garrett, said other attorneys in the 10th Circuit Public Defenders Office will handle the appeal... The three-judge appeals panel will decide if sufficient evidence existed to convict Parker, but it won't reweigh that evidence, Garrett said. Instead, appeals are based on judicial errors that may have occurred, which could win Parker a new trial. [Excerpts] The recent murder conviction of former Avon Park Police Officer James Parker has prompted a renewed effort to free Michael Diaz, who is serving five years in prison for battery on a law enforcement officer. League of United Latin American Citizens (LULAC) Civil Rights Commissioner Victor Valdes told a gathering Monday afternoon that Parker accused Diaz of attacking him, which led to Diaz's five-year prison sentence. Parker's employment records show several problems against him, Valdes noted. "But the chief didn't pay attention to us," Valdez said. Just a few months later Parker killed a 20-month-old child... "We hope now that Sheriff (Susan) Benton and the state attorney will review the Diaz case in order to find what we are denouncing — police brutality against a Hispanic family"... An Avon Park Police report states that Parker, who was off duty, said that Diaz and his sister were involved in a domestic dispute. Parker attempted to intervene when Diaz struck him several times in back of the head. Diaz was sentenced Feb. 4, 2009, to five years in prison after pleading "no contest"... Parker was arrested March 29, 2009, after being charged with aggravated child abuse of the 20-month-old baby girl of his live-in girlfriend. After his arrest in 2009, Highlands Today checked Parker's personnel file, which showed he had five commendations as well as four disciplinary notices. On July 7, 2008, Parker was suspended without pay for two days when he was found to be incompetent or inefficient in the performance of his duties. There were problems reported regarding evidence collected on 19 different criminal cases dating back to April of 2008, a disciplinary notice stated. [Full article here]

[Excerpts] When women intentionally and maliciously turn on one another, it really bothers me. I am especially frustrated when I see another woman re-victimize someone who has already been victimized... Rosaura Torres wrote a book about the years of abuse she survived at the hands of her husband. The book, Abuse Hidden Behind the Badge details her life, beginning when she was a child and ends with her story of survival and fight for justice when she is finally left with loss of vision in one of her eyes. Torres abuser was a cop... A self proclaimed journalist at LIPNews - Lancaster Independent News - took an interest in Torres story. She spent a lot of time with her discussing the book and gaining Torres trust. Within days and without warning the “journalist” posted on her blog a scathing review of Rosa’s book - even though she admitted several times that she didn’t actually read the book... In my research I discover that this woman had been a victim of sexual abuse and incest, which she herself had written about. It helped me to understand her better and to understand the depth of her anger. The depth of her pain... However, until one is willing to the do the work that is necessary to heal old wounds, they will continue to lash out at others. And at what point do we expect people to take responsibility for their actions?... The “journalist’ and Torres are two women who share backgrounds of abuse. One has done the work needed to heal. One has not. It took a great amount of courage for Torres to write her book. I also feel in writing the book, she found some healing. She let the secrets out that she was taught to keep. That is never easy. Her book was painfully honest, even during the times in which she reveals things about herself that were hard for her to face... In the end we are SISTERS and WARRIORS that have to keep reaching out to one another. We have to keep holding each other up and not pushing each other down.
